01/08 - Finally after waiting 4 long years RDHs can finally take courses for administering local anesthesia that have been approved by the TN Board of Dentistry.  Several TN Dental Hygiene schools are in the process of setting up programs which will begin soon

HOUSE JOINT RESOLUTION 314

A RESOLUTION to commemorate the 60th anniversary of water fluoridation.
WHEREAS, adequate water supply and water distribution systems are essential to the
health, safety, and economic welfare of the people of this great State; and
WHEREAS, fluoridation of community water supplies is the single most effective public
health measure to prevent tooth decay; and
WHEREAS, January 25, 2005, marked the 60th anniversary of fluoridation of community
water, and community water fluoridation continues to be the most cost-effective, equitable, and
safe means to provide protection from tooth decay; and
WHEREAS, in March of 1951, Milan became the first city in Tennessee and the second
city in the Southeast to add trace amounts of fluoride to the community water supply; today, 95
percent of all Tennesseans who obtain water from community water supplies receive water
containing optimum fluoride levels (~1.0 ppm); and
WHEREAS, in 1953, the Tennessee fluoridation program was elevated to division status
and granted legislative authority with state appropriations for community water fluoridation in the
budget of the Department of Health; and
WHEREAS, Tennessee became the first state to offer financial assistance to small
communities for water fluoridation; enabling more communities to fluoridate their drinking water,
these measures resulted in a decrease in the tooth decay rate in Tennessee; and
WHEREAS, in 1979, the State of Tennessee and the Centers for Disease Control and
Prevention established a National Fluoridation Training Center at the Fleming Training Center in Murfreesboro, Tennessee; and
WHEREAS, in 1998, Tennessee became one of the first states to provide information on
oral health issues to teachers, parents, children, health professionals, and the general public via the Internet; and
WHEREAS, providing leadership and innovation in the field of community water
fluoridation, the great State of Tennessee has evinced a deep commitment to the health of its
citizens by providing clean, fluoridated drinking water; and
WHEREAS, it is fitting that this General Assembly should pause to recognize and
celebrate the 60th anniversary of community water fluoridation; and
BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE ONE HUNDRED
FOURTH GENERAL ASSEMBLY OF THE STATE OF TENNESSEE, THE SENATE
CONCURRING, that we hereby recognize and commemorate the 60th anniversary of community
water fluoridation and recognize the oral health benefits fluoridated water provides the citizens
of this great State.
BE IT FURTHER RESOLVED, that an appropriate copy of this resolution be prepared
for presentation with this final clause omitted from such copy.

The next steps for this legislature are...

The bill will go to the Governors desk for signature. 
After the signing,

A.
1.) the BOD will have to promulgate the rules.  (This may happen as soon as the May 19-21 meeting, or the called June 3 & 4 meeting.  If not, the rules will be on the agenda for the September meeting) 

2.) When the BOD promulgates the rules, the public is allowed to submit testimony at a published hearing date. 

3.) Then, the BOD considers any testimony at its next meeting, and votes on the rules. 

4.) Then, the BOD approved rules go to the Attorney Generals office for review and sign off. 

5.) THEN, the LA courses can be taught, & Registered Dental Hygienists can provide this service if the Dentist delegates it.

AN ACT to amend Tennessee Code Annotated, Title 63, Chapter 5, relative to the practice of dental hygiene.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Section 63-5-108(d), is amended in the first
sentence by deleting the language ", except those procedures requiring professional judgment or skill ".
SECTION 2. Tennessee Code Annotated, Section 63-5-108(d)(3), is amended by
deleting the subdivision in its entirety and by substituting instead the language:
(3) Administration of a general anesthetic.
SECTION 3. This act shall take effect July 1, 2004, the public welfare requiring it.

by deleting all language after the enacting clause and by substituting instead the following:
SECTION 1. Tennessee Code Annotated, Section 63-5-108(b)(12), is amended
by deleting the subdivision in its entirety and by substituting instead the language:
(12) Administers an anesthetic, except for a topical anesthetic in
connection with a dental operation. Provided however, a duly licensed dentist may delegate the administration of local anesthetic to dental hygienists who possess a permit to do so issued by the board. The board shall establish the qualifications, criteria and curricula required for issuance of permits to administer local anesthetic, by infiltration or by block, to duly licensed dental hygienists.
SECTION 2. Tennessee Code Annotated, Section 63-5-108(d), is amended in the first sentence by deleting the language "except those procedures requiring professional judgment or skill; " and by substituting instead the language ", except those procedures requiring the professional judgment or skill of a dentist;".
SECTION 3. Tennessee Code Annotated, Section 63-5-108(d)(3), is amended by deleting the subdivision in its entirety and by substituting instead the language:
(3) Administration of a general or local anesthetic, except for a topical
anesthetic in connection with a dental operation. Provided, however, dental hygienists who possess a permit issue pursuant to subdivision (b)(12) may administer a local anesthetic but only under the direct supervision of a licensed and registered dentist in accordance with rules and regulations of the board.
SECTION 4. This act shall take effect July 1, 2004, the public welfare requiring
it.
